Our client and his son went for a swim at a recreation center, where there was a lifeguard on duty.  As he was swimming, our client began to sink under the water.  Unfortunately, the lifeguard was not paying attention which caused our client to submerged under water for close to four minutes before the lifeguard finally realized what was happening and began efforts to pull him from the water and resuscitate him. As a result of being under the water for an extended period of time, our client suffered a severe hypoxic brain injury due to being deprived of oxygen.  Although he was able to be resuscitated, he sustained significant brain damage.  He lived with in this devastated state for sixteen months in various hospitals and rehabilitation centers until he succumbed to his injuries and passed away. Our client left behind a wife and three children who retained our law firm to bring a negligence and wrongful death lawsuit on their behalf. Schulman Blitz, LLP engaged the services of numerous experts to prove our case, including investigators, a world-renowned water safety expert, a pathologist, a cardiologist and an economist to prove the value of the economic damages caused by this tragedy. Due to the diligent work by the attorneys at Schulman Blitz, LLP, in connection with numerous photographs and videos that the family took, we were able to show that as a result of the incident, the decedent suffered terribly during the extended time that he lived following the drowning. We were able to show that his death was a direct result of the negligence of the defendants. An image of a brain after suffering the devesatating brain damage caused by drowning After extensive litigation, Justin Blitz, Esq. and Fred Schulman, Esq. settled the case following an out-of-court mediation for a confidential amount.  Although no amount of money can changed what happened, the settlement will provide our client’s family with significant compensation for the tragic loss of their beloved husband and father.

Fred Schulman, Esq. settled a case for $925,000 for a truck driver who was involved in an accident with another truck. The defendants’ truck went through a red light at a high rate of speed and struck the truck that our client was driving. As a result of the impact, our client sustained various fractures and neve damage to his leg, including peroneal neuropathy, which caused a permanent foot drop.
