Blitz Law Group, LLP is pleased to announce the successful settlement of our client’s case for $3.75 million. This case centered around the medical treatment received by a cherished member of the Far Rockaway community known for his vibrant personality and numerous talents.
Our client was a devoted father, skilled basketball player, and passionate musician and entrepreneur. In February of 2018, our client, who was 28 years old at the time, sought medical attention for asthma symptoms at a hospital in Queens. Despite receiving several treatments, his vital signs rapidly declined, leading to the decision to perform an endotracheal intubation to assist with his breathing.
During intubation, complications occurred, and subsequent chest X-rays showed that the endotracheal tube was improperly placed. It is necessary fora physician to insert an endotracheal tube through the larynx.
Unfortunately, our client’s physician inserted the tube through his esophagus, causing him to lose carbon dioxide to his brain. Despite efforts to stabilize him, our client tragically passed away days later.
The Blitz Law Group filed a lawsuit against the hospital, the physician who improperly inserted the tube, and the radiologist who read the original x-ray wrong and reported that the tube was correctly inserted.
During the legal process, it was discovered that our client had been treated in a manner that was contrary to the standard of care. As part of our claims of malpractice, we alleged that the endotracheal tube was placed incorrectly, and that the subsequent chest x-ray was read incorrectly.
Over the course of three years, Justin Blitz litigated the case, taking ten depositions, and successfully defending various motions.
In a mediation just before trial, a settlement of $3.75 million was reached, which provides our client’s family with the resources they need to move forward while keeping his memory alive.
