Justin Blitz was able to resolve our client’s case for $4,000,000 during trial for an iron worker who was erecting a building in midtown Manhattan and fell from a ladder that broken and defective. Our ironworker client suffered injuries to both of his knees when he fell from the ladder. We alleged violations of the labor law including violations of New York’s labor law sections 200 and 240. Our client was a member of the union and had been performing iron work for close to 30 years when he fell from the ladder. When our client walked into her building on the upper east side of Manhattan, she fell down the three steps that were in front of the entrance to the building. As a result of the fall our client sustained a fracture to her pelvis. Justin Blitz was able to establish that the steps were in violation of the New York building code since they did not have a handrail that someone could grab onto when walking down. Our client suffered a lateral meniscus tear of his knee that required surgery because of his fall. When our client when to fix an issue with the paper producing machine, he stepped into the hole that he was not able to see due to foam that was the residue of the machine that produces the paper. The hole was missing the grate that covered it and there was no caution tape or warning sign informing our client that it was missing the grate. Our client was visiting New York City with her daughter to see a couple Broadway shows and when she returned to her hotel, she fell down the steps. The steps were cracked and the tape that provided the steps to not be slippery was sticking up which caused her to trip and fall down the flight of stairs. As a result of the accident our client suffered a fractured nose, a gash on her forehead that required stiches and a chip fracture of her C3 vertebrae in her spine. After an inspection of the steps and negotiations with the insurance company of the hotel Stephanie Mastrocola was able to resolve the case prior to litigation.

In May 2022, our client was a pedestrian crossing 107th Avenue in Queens, NY, when he was struck by a car. There was some dispute as to whether he was in the crosswalk at the time of the accident. As a result of the collision, our client sustained severe injuries, including a comminuted fracture of his femur and a fracture of his tibial shaft. These injuries required surgery, during which an external fixator and screws were inserted. External fixation for a femur fracture involves placing metal pins above and below the fracture site, with rods and clamps used to hold the pins in place externally, ensuring proper bone alignment during healing.
